Terms of Service

OyePost is a product of XMISS — a proprietorship of Priyam Gangrade, Mumbai, India — which also operates The Upcycle Story (theupcyclestory.in). OyePost is the parent brand of Oye Orders (restaurants), Oye Gym (gyms) and OyeSociety (housing societies).

By using OyePost or any of its products (Oye Orders, Oye Gym), you agree to these terms.

1. The service

OyePost turns photos and videos you send on WhatsApp into branded social media posts and, on paid plans, publishes them to your connected Instagram account after your approval. Features and limits vary by plan.

1a. Gym and studio plans

Gym plans additionally include member records and renewal reminders, member-submitted content, an in-gym display screen ("Live Wall"), automated replies to Instagram and Facebook comments and messages, and reports. Where you give us member data you confirm you are entitled to share it and to contact those members. Member content is published only after the member consents and you approve it. Members can reply STOP on WhatsApp to choose which messages they receive; we will honour that.

Messages to members who have contacted the service in the previous 24 hours carry no per-message charge. Reaching members outside that window requires Meta-approved templates, which Meta charges for at its own rates; we will tell you the count and estimated cost and will not send them without your confirmation.

Businesses on our larger plans are covered by a separate signed agreement, which prevails over these terms where the two differ.

1b. Oye Orders — restaurant plans

Oye Orders gives a restaurant its own WhatsApp ordering channel: a QR code, a digital menu page, online or cash payment, order management on WhatsApp, and delivery tracking. It is charged as a flat subscription — we take no commission or per-order fee, and customer payments go directly to the restaurant through its own payment account.

The restaurant is solely responsible for its menu and prices, food quality, hygiene and safety, packaging, delivery, applicable FSSAI licensing and taxes, and for honouring or refusing orders promptly. Oye Orders is the technology provider only — we are not the seller of the food, not a party to the sale, and not a delivery service.

Orders not accepted within 15 minutes are cancelled automatically and any prepaid amount is refunded to the customer through the payment processor. The restaurant authorises us to trigger these refunds on its behalf.

Customer details collected through a restaurant's own ordering channel belong to that restaurant and can be exported or deleted on request. The restaurant confirms it will use them lawfully and honour opt-outs. Restaurants may also appear in Oye Orders' area-level discovery features, which surface options only when a customer asks for them; a restaurant can opt out by telling us.

1c. Your WhatsApp and Meta accounts

Oye Orders can run on your restaurant's ordering channel in one of two ways, and the difference matters:

You own your accounts. Your WhatsApp Business Account, your phone number, your business verification, your display name and your Meta Business Portfolio remain yours. We do not take ownership of them, we do not transfer them to ourselves, and we do not hold them as our own assets. We never ask you to hand over a SIM or to become a user of our business portfolio in order to be served.

We act on your behalf, with your permission. When you connect your account, you grant OyePost access as your technology provider so we can send and receive your order messages, manage message templates, configure webhooks and help set up your number. We use that access only to operate the service for you. We do not message your customers for our own purposes, and we do not use your account to serve any other business.

You can revoke access at any time. Message us, or remove OyePost from your own Meta Business Settings. Revoking takes effect immediately and stops all access. Your account, your number and your customer list stay with you — you do not lose them by leaving us, and you do not need our permission to go.

Credentials. Access tokens are held encrypted on our servers, are never shown in your browser, and are deleted when you disconnect or close your account. See our Privacy Policy and Data Deletion page.

Your data is yours. Your menu, your order history and your customer details belong to your restaurant. You can export them or ask us to delete them at any time, whether or not you remain a customer. Your customers keep their own rights over their personal data regardless of this agreement.

To run the service, you grant OyePost a limited, non-exclusive licence to store, edit (branding, captions, layouts, video edits) and publish the content you send us — on your own connected accounts (Instagram feed and Stories, and where enabled, your Facebook Page and Google Business Profile), always on your behalf and with your approval flow. You remain the owner of your content. You are solely responsible for having the rights to everything you send — including customers' photos (take their consent before sending job photos) and any music inside videos. This licence ends when you stop using the service, except for posts already published to your own accounts.

We work hard to produce high-quality posts and improve your reach over time, but we cannot guarantee any specific level of followers, reach, or sales — social media outcomes depend on many factors outside our control.

6. Service availability

We rely on third-party platforms (WhatsApp, Instagram, payment and hosting providers). Occasional downtime or changes by these platforms may affect the service. We aim to restore normal service quickly.

7. Cancellation

You may cancel any time; your plan stays active until the end of the paid period. See our Refund & Cancellation Policy.

8. Limitation of liability

The service is provided "as is". To the extent permitted by law, our liability is limited to the amount you paid us in the previous month.

8a. Third-party platforms

The service depends on Meta (WhatsApp, Instagram, Facebook) and other providers. If those platforms change their policies, pricing or APIs, affected features may change or stop. We will make reasonable efforts to restore or replace them, but we are not liable for platform-side changes outside our control.

9. Governing law

These terms are governed by the laws of India.
